Yes it would. And I have argued that in my appeal over Anglo. Though the way the Information Commissioner is reading the legislation, they seem to think Anglo would not.

Emily is a disappointment.

Promotion within a corrupt organization is usually after having established a vital hold over the person involved. Merit and pay are insufficient, given the corrupt nature of the regime. Those who are honest are usually compromised and that will be used against them if they do not toe the line. The Ireland Jersy covers a multitude of methods of enforcement.

@Jagdip Under the Nama Act, an application for leave for judicial review of its procedures has to establish “substantial grounds” for leave to be granted.

EIR only relates to the SI itself, and the definition of public authority contained therein.

Sorry Gavin for a short and not very considered comment but does the fact that NAMA is subject to judicial review (as evidenced by the forthcoming case with Paddy McKillen) not tend to mean that NAMA is a public body?

“I take the view that Article 3(1)(a) of the definition of “public authority” is meant to refer to a Department of State or local authority or other State body within the executive branch of government; it does not refer to a body with an economic or commercial mandate such as NAMA.”………………….under this logic, the Department of Finance would NOT be a public authority!
